Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction. 2. Congress shall have the power to enforce this article by appropriate legislation. The 13th Amendment was needed in order to make slavery officially illegal, because President Abraham Lincolns Emancipation Proclamation during the war did not free the slaves or end slavery. The first phase of the Thirteenth Amendment to the Constitution of the United States came about in 1865, on a vote of 121 to 4 in the United States Congress on January 31. Less than a year later, December 6, 1865, the second phase was completed as the amendment was ratified by the states and became part of the Constitution. Only the state of Mississippi rejected the amendment; but Florida, California, Oregon, Iowa, New Jersey, Texas, Delaware and Kentucky did indeed ratify the Thirteenth Amendment
