...... It is not only the fact that innocent people plead guilty in the United States justice system that raises ethical concerns, but also the motives that often lie behind such decisions. Several of the practices that plea bargains tend to encourage in prosecutors are ethically dubious at best. In some cases, charges that would never stand up in a trial are included specifically to force a defendant and their often beleaguered defense attorney to plead guilty to lesser charges, which constitutes deliberately presenting a false set of circumstances before the defendanthardly the fair trial by a jury of his or her peers that every defendant is Constitutionally entitled to (Banks 2009). Though not quite outright lying, such tactics intentionally exploit the naivety of the defendant and the case load of most criminal defense attorneys, especially those appointed by the courts, in order to score a quick and easy win for the prosecutor
